ORAL ARGUMENTS -- MOCK SUPREME COURT SESSIONS & DESCRIPTOR

MOCK SUPREME COURT HEARINGS

Each side will have 15 minutes provided for the oral argument.

The petitioner (appellant) will argue first and will have 12 minutes for the argument and responses to questions, with 3 minutes reserved for rebuttal.

The respondent (appellee) gets one shot at argument and therefore will have the full 15 minutes available for argument and responding to questions.

Both sides should use the brief as a guide to the argument, starting out with a clear statement of the legal issue(s), the facts of the case, how the case worked its way to the Supreme Court, what the arguments/precedents are that support your position, and arguments/precedents for the other side that you feel you should respond to.

Be aware that justices can and should be interrupting you for questions throughout your time slot.

Justices should have read each side's brief and have the briefs in front of you as the arguments are presented. It is expected that each justice will ask questions of the attorneys: either clarifying questions about their own brief/argument/precedents, or questions concerning the other side's brief/argument/precedents.

Once the arguments for both sides are completed, the justices will consult with one another and vote on the outcome, and announce the result. In order to prevail, the petitioner/appellant will need to get a majority of the court votes; a tie or majority for the respondent/appellee means the appeals court's decision is upheld (affirmed).
